What is TOYS?
The EU Toy Safety Directive 2009/48/EC was issued on June 30, 2009, effective July 20, 2009, and partially invalidated the current Directive 88/378/EEC on July 20, 2011 and the new chemical requirements will be Effective in July 2013.
The old EU Toy Safety Directive 88/378/EEC, since its promulgation in 1988, has made great achievements in ensuring toy safety in the EU market and eliminating trade barriers between member states. However, with the changes of the times, the inadequacies of the directive are increasingly exposed, such as the need for further improvement in security requirements, inefficient implementation of instructions, and lack of clarity in scope and concept. And toys on the market use more and more new materials. So in 2003, the EU began to consider revising it and collecting public opinions. On January 25, 2008, the European Union issued the revised directive COM (2008) 9. On December 18, 2008, the European Parliament passed the proposal, and the official text was passed on June 18, 2009, and finally ended on June 30, 2009. Published in the Official Journal of the European Union, the new directive is numbered 2009/48/EC.

After the new directive is issued, each member country will convert it into national law within 18 months, that is, before January 20, 2011.
In addition, the new directive also sets a two-year transition period, that is, products that meet the requirements of the old directives can continue to be placed on the market before July 20, 2011; and the transition period of the chemical requirements clause is four years, that is, the old ones are met. Products with chemical requirements in the Directive that do not meet the chemical requirements of the new Directive may continue to be placed on the market by July 20, 2013.
Changes to the new Directive "Toy" scope and definition: Products designed or used for play by children under the age of 14, whether or not they are specifically intended for play.
Requirements for each economic operating entity:
First, the manufacturer:
A. Ensure that the toy design meets the basic safety requirements and special safety requirements of the EU.
B. Develop a Product File/Technical Document and implement a conformity assessment process (ie, conduct a conformity assessment/safety assessment). Develop an EC Declaration of Conformity when the product evaluation results are acceptable
C. After the toy is put on the market, the product file and EC declaration of conformity must be kept for 10 years.
D. It must be ensured that production-qualified procedures are in place throughout a series of production processes, and that changes in conformity caused by any design or feature changes and updates to the harmonized standards referenced must be fully considered.
E. The type, lot or serial number or model number, or any other identifying information must be indicated on the toy: when limited by the size or characteristics of the toy, this information can be noted in the package or in the instructions.
F. Their name, registered name or registered trademark and the address to be contacted must be marked on the toy or packaging; when the toy is limited in size, the above information can be indicated in the attached manual.
G, instructions and safety information must be written in a language that is easy for consumers in their member countries to understand.
H. When the manufacturer manufactures or has reason to believe that the toys placed on the market do not comply with EU regulations, the necessary corrective actions must be taken immediately, withdrawn or recalled. When the toy is at risk, the competent authorities of the member states must be notified immediately.
I. Upon receipt of the request of the competent authority, all information and documents must be provided to prove that the toy is qualified. At the same time, cooperate with them to take action to eliminate the dangers of toys.
Second, importers and distributors require
The new directive requires importers and distributors to check level by level, including:
- The importer should check whether the manufacturer meets the relevant requirements, such as whether there is a technical file, whether to conduct a conformity assessment procedure, and if necessary, a random sampling test;
- a mark of conformity, such as placing the name of the importer on a toy or package for contact;
- Ensure that the instructions or other materials on the toy are written in a language that the consumer can understand
- Ensure that the toy transport or storage process still meets the requirements.
Third, greatly enhanced the requirements of chemical properties
A. Toys must comply with EU Directives on certain types of products, as well as restrictions on certain substances and mixtures (including REACH)
B. Prohibit the use of carcinogenic, genetically modified or reproductively toxic substances (CMR) in toys or toy parts.
C. The toy itself is a substance or a mixture and must comply with relevant directives and regulations.
D. Strengthened restrictions on the migration of heavy metal elements
Fourth, changes in mechanical properties
A. It is forbidden to attach the toy firmly to the food.
B. Toys sold with food must be packaged separately, and such packaging must be protected from swallowing or inhalation, and must be marked with a warning statement.
C. For the vocal toy, the maximum pulse and continuous noise can not damage the child's hearing.
V. Strengthening of health requirements:
A. Toys must meet hygiene and cleaning requirements to avoid any risk of disease, contamination and infection.
B. Toys designed and manufactured for children under 36 months must be cleanable.

The new directive requires importers and distributors to check level by level, including:
1. Strengthen the rules applicable to warning signs: accurate, significant, clearly clear and easy-to-read warning signs must be displayed at the point of sale, including the Internet store.
2. When the warning signs used conflict with the intention of the toy, these warning signs cannot be marked.
3. The warning word can be printed on the toy. Secure on toy labels or toy packaging, as appropriate. Should also be printed on the instruction manual
4. If the toy is not packaged at the time of sale due to its volume, the warning must be fixed on the toy.
